ATC have a provisional patent. That doesn't mean much. Long way to go to prove they have something differentiated and protectable. ~2 years minimum to go through normal processing times, examination, third party objections, etc... before it may become a regular patent. Until it is formally a full patent, there is just about nothing they can do legally against anyone.
