That's how I see it, I've read their announcements closely and there is no ground at all, which explains why the bank didn't even mention it in the covenant.....if you think they are honesty not going to charge legal fees.....if they win, they will get a big slice of compensation percentage, if they loss, who do you think will foot the lawyer's valuable and exorbitant time for "discovery" and "writing documentation".
