    The fact is when embarking on exploration there is an element of risk and uncertainty if any resources will be found as a result of exploration.
    On this basis i believe the judge wont award damages for potential loss of earnings. Furthermore, it is unlikely LKO would have been granted a production licence.
    This matter soley focuses on the fact that LKO was granted a licence and the retrospective legislation that was introduced. Not only did the legislation contradict previous statutes. It attempted to exempt all liability and damages.
    The question is whether this is legal.
    If so then why would any company ever invest again with a possibility they will have their licence cancelled and have no means for recourse !! Furthermore, in not answering LKO questions, or offers for clarity, the word “certain” licences means there is some form of discretion. Talk about lack of transparency !!
    Do you think companies in this country have, or carry contingency on the basis that any contract can be cancelled anytime despite monies invested. This would be as close to chaos theory as you could imagine.
    This is why the “rule of law” and the laws that govern us include common law should apply.
    If governments think they are above the law and not answerable to the law, wrong answer. They have to be seen to upholding the law and applying the law of the land.
    They should never be seen to try and circumvent rights enshrined in law, especially contract law, or as in this case it might find itself on the wrong side of the law and having a judge to correct matters.
    Operating in different countries is a whole different matter. In the case of DHR i did take a long hard look at the geopolitics of Argentina before investing.
    However, if operating within ones own country one should have to consider governments acting so arbitrarily. One would like to think transparency, common sense and fairness apply.
    The judge handling the case is a seasoned trial lawyer in his early career, has seen and knows how the criminal mind works and as i’ve mentioned written a number of papers on civil matters. So not for a minute do i think anyone will be able to deceive, or pull the wool over his eyes. I also am a firm believer the bar and the judiciary are separate from the government for clear reasons.
