I think we can just assume US$200M at this stage (which translates to $1.20/share).
If Zurich and their syndication push it all the way to NSW Supreme Court then the judge will simply be asked to decide as to:
(1) whether T&C of PRI policy match the actions taken by Thai PM to order the premature closure of Chatree (and for that matter all gold mining in Thailand) has deprived them of the benefit of this asset
(2) Confirm non-disclosure provisions have not been breach and even if so would it have resulted in the insurer not entering into the contract
They will not then be asked to make a partial award if KCN have independent advice to support their claim as to the financial impact caused equals or exceeds US$200M.
