This is old discussion ground which I find curious that you need to raise again?
Almost all such cases see a negotiated settlement as both parties have an incentive to control their own destiny rather than leave in hands of courts. The only way I see this going the distance to July hearing in NSW Supreme Court is Zurich not offering a reasonable sum to KCN. Your attention should be focused on what “reasonable sum” may equate to. Ross stated in AGM he and Board have sort the full risk liability of US$200m under the policy. I’d suggest anything under A$50m is unlikely to see the KCN board change their current tack.
What I’ve learnt my investments - Patience is a genuine virtue in share investing if you understand your downside risk, whilst watch for systemic change in your thesis and simply sitting on you hands until the story unfold.
