Some people might be wondering/worrying over the EE allegations and why AVZ has not done anything about them.
This part of the defamation act might help explain.....

"DEFAMATION ACT 2005 - SECT 9

mce-anchormce-anchormce-anchormce-anchor9 . Certain corporations do not have cause of action for defamation

(1) A corporation has no cause of action for defamation in relation to the publication of defamatory matter about the corporation unless it was an excluded corporation at the time of the publication.

(2) A corporation is an excluded corporation if —

(a) the objects for which it is formed do not include obtaining financial gain for its members or corporators; or

(b) it employs fewer than 10 persons and is not related to another corporation,

and the corporation is not a public body. "

My understanding is that AVZ cannot take any action against EE for their public posts, as they concentrate on 'the company'.

However because of this, IMO the company should come out and refute all the allegations, to quell the nervousness shown by some holders.

Personally I believe the EE stuff is a red herring and nothing to do with today's suspension.

As I stated earlier in the day, IMO the suspension is all about the AFR advertorial, especially the new timelines, and possibly in particular the mention of the DFS in 2019. I have not seen a mention of a DFS in any announcement, nor a timeline for anything other than a PFS for Q4 2018.

Personally I think going straight to a DFS is a very smart move and shows commitment to get on with the job and mine this beast, but why announce it in an advertorial???

IMO management has made an error in not releasing the info in today's AFR as an announcement, especially as they are under the regulator's spotlight.

Instead of a simple "Change of timeline" announcement before trading today, the company now has to most likely answer queries about why info was given to press without an official announcement. Being in the All Ords since March, instead of just being another junior explorer, would certainly bring higher levels of expected compliance to the rules.
