The class action is unfunded at this time. The lawyers involved has told ILU not to spend money preparing a defense until or unless they choose to proceed. This is to protect those behind the class action from being obliged to meet ILU's incurred costs should they cancel the action.

Whether this removes the class action proponents' liability would be worth arguing in court. They retain the option to continue, a possibility ILU must prepare for.
