I can only guess, but I would be thinking about:
Delaying the project - would not want to be embarrassed by delays to market and tech support issues caused by Optiscan in-fighting, so a conservative approach would be to park it for a while and see what happens.
I am not sure about the IP agreement with Optiscan, but perhaps when Optiscan have gone broke after losing their main customer, they could get to IP for nothing and then employ the key staff if they are still available and do it themselves.
