This is my opinion. Courts don't consider right or wrong. Courts consider only Law. In this instance the Victorian Govt. is in breach of contract to LKO. This is straight contract law. Secondly the Victorian Govt. passed legislation that is (again in my opinion) legal but not lawful that seeks to indemnify itself against the breach it committed. To me this amounts to criminal conduct. Should the judge rule in favour of the Govt. it will blow Pandora's box wide open. It would have the effect of allowing any Govt. to break any rule or law and then indemnify itself. In other words, "Rule of Law" in Australia would be nullified.
