High Court. If the state loses very very likely they will appeal. This kicks the whole thing in to touch until after the next election.
Also depending on how clear the law is on such matters will determine whether the judge grants leave to appeal. In some cases where it's clear cut then they wont. However, given the ambiguity here most likely it will be appealed.
